Terms of Service

Forward America provides computing and information services ("Service") to those persons ("Users") who utilize its Service. By using the Service, each User agrees to be bound by all of the Terms of Service set forth in the following paragraphs.

Payment for Service is charged to the User's credit card by Forward America at the start of Service for the period of service and rate selected by the User. Service will be automatically renewed for subsequent service periods of equal duration with payment charged to the User's credit card at the beginning of each new period. Service may be terminated at any time by either party. Users may terminate their Service by accessing and changing their account records at the ForwardAmerica.com web site. Forward America may terminate the Service by notifying Users at the "contact" email address they specify when opening an account. When Service is terminated Users will be refunded the Service fee paid for any remaining full weeks in the current service period after an initial four week minimum.

Forward America undertakes no responsibility to review the contents of any information provided to Users, including but not limited to information accessed through links to other sites and forwarded email, and by using the Service each User agrees that Forward America shall have no liability for such contents.

Forward America may not be utilized for commercial email solicitations, advertising, offensive or illegal communications, communications which infringe intellectual property rights, or communications which harass, intimidate or otherwise violate the rights of others. Forward America reserves the right to terminate the Forward America account of any person who violates this policy.

Forward America reserves the right in its sole discretion to deny access to any User.

By providing information to Forward America, each User hereby grants permission for Forward America to use such information for any purpose unless a restriction on such use is transmitted to Forward America by email prior to such use. Forward America shall not, however sell or otherwise provide such information to any other entity for the purpose of solicitation of any kind. (See the Forward America Privacy Policy).

Each User hereby indemnifies Forward America against any liability relating to Forward America's use of information provided by such User or relating to such User's violation of these Conditions of Use.

These Conditions of Use may be modified by Forward America at any time by publication through the Service.

EACH USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT THE USER'S SOLE RISK. NEITHER FORWARD AMERICA NOR ANY OF ITS LICENSORS, EMPLOYEES, OR AGENTS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES FORWARD AMERICA OR ANY OF ITS LICENSORS, EMPLOYEES OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. THE SERVICE IS DISTRIBUTED ON AN "AS IS" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS SERVICE. NEITHER FORWARD AMERICA NOR ANY ONE ELSE INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICE SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF USE OF THE SERVICE OR INABILITY TO USE THE SERVICE OR OUT OF ANY BREACH OF ANY WARRANTY.
